Civil case - Civil rights. The district court did not err in holding
defendant Wolfe violated plaintiff's Fourth Amendment right to be free
from excessive force, because her use of force was objectively
unreasonable as a matter of law; at the time of plaintiff's arrest he had
committed no crime, was not resisting arrest and had not acted
aggressively or in a manner which threatened defendant or other officers;
plaintiff's right to be free from excessive force was clearly established
at the time of the incident, and defendant was not entitled to summary
judgment based on qualified immunity.
