U.S. Court of Appeals Case No: 16-3591
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Murphy, Author, with Beam and Benton, Circuit Judges]
Civil case - Civil Procedure. Plaintiffs failed to show that it was
legally impossible for them to recover more than $5 million in damages,
and the district court did not err in denying their motion to remand the
matter to state court; nor did the court err in granting Progressive's
motion to dismiss under Rule 12(b)(6) as Minnesota's No Fault Act allows
insurers to offer policies with deductibles which reduce coverage below
$20,000 for medical expenses and $20,000 for economic loss.
