Civil case - Employment Discrimination. The pendency of an EEOC review
does not toll a state civil rights claim and plaintiff's claim under the
Iowa Civil Rights Act was properly dismissed as time-barred; the actions
of the store customer in the incident in question did not constitute
conduct so severe or pervasive to affect a term, condition or privilege of
plaintiff's employment, and the district court did not err in granting
defendant summary judgment on her claim of hostile work environment;
further, plaintiff failed to show defendant knew of the customer's
harassing conduct but failed to take remedial action; district court did
not err in excluding evidence of plaintiff's previous sexual assault and
her related therapy under Federal Rule of Evidence 401; the district court
did not err in finding plaintiff's retaliation claim was time-barred.
