U.S. Court of Appeals Case No: 16-3927
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Kelly, Author, with Colloton and Benton, Circuit Judges]
Civil case - Insurance. The district court did not err in determining the
general commercial policy in question did not provide coverage for damage
plaintiff caused to an electrical transformer while working on it; the
damage was excluded under the "particular part" exclusion which excluded
coverage for property damage to a particular part of any property on which
plaintiff performed work if the work was performed incorrectly on that
particular part; here, the damage to an interior coil was caused by
plaintiff's failure to properly detach a cable from a bushing before
attempting to lift the bushing and the resulting damage to the transformer
was not covered.
