164127P.pdf 03/13/2018 Thomas Boaz v. United States of America
U.S. Court of Appeals Case No: 16-4127
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Gruender, Author, with Loken and Kelly, Circuit Judges] Habeas Case - motion to vacate. Boaz's 1974 conviction for exhibiting a deadly weapon in violation of Arizona law qualifies as a predicate offense under the force clause of the Armed Career Criminal Act and thus the district court's denial of a motion to vacate his sentence after Johnson v. United States is affirmed. Arizona statute is materially indistinguishable from a Missouri statute (Mo. Rev. Stat. Sec. 571.030.1(4)), which has been held to satisfy the force clause of the ACCA.
