   Criminal case - Criminal law and sentencing. The district court did not 
   clearly err in determining defendant abandoned his cell phone when he 
   crashed his car, fled the scene of the accident and left the phone in the 
   abandoned car; defendant's Minnesota second-degree and third-degree 
   burglary convictions do not qualify as violent felonies for purposes of 
   sentencing under the Armed Career Criminal Act, and the matter is remanded 
   for resentencing.
