U.S. Court of Appeals Case No: 17-1019
U.S. District Court for the Eastern District of Arkansas - Pine Bluff
[PUBLISHED] [Kelly, Author, with Smith, Chief Judge, and Arnold, Circuit
Judge]
Prisoner case - Prisoner civil rights. Defendants did not file a timely
appeal from the order denying their motion for summary judgment based on
qualified immunity, and they could not challenge the order in this appeal
from an order denying their motion for reconsideration under Rule 60(b);
with respect to the order denying defendants' Rule 60(b) motion, the
district court did not abuse its discretion by denying the motion, as the
district court did not err in distinguishing this case from the court's
decision in Cullor v. Baldwin, 830 F.3d 830 (8th Cir. 2016).
