U.S. Court of Appeals Case No: 17-1066
U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED] [Loken, Author, with Arnold and Shepherd, Circuit Judges]
Criminal case - Criminal law. The district court did not violate
defendant's Sixth Amendment right to meaningful cross-examination when it
refused to let him impeach a government witness with two prior convictions
because more than 10 years had passed since any confinement on the charges
and the probative value of the information was substantially outweighed by
its prejudice; further, defendant had already impeached the witness with a
prior drug conviction which made the point defendant was trying to show
with the other convictions - that the witness was motivated to testify to
avoid additional punishment; no error in denying defendant's request for a
buyer-seller instruction as it was not supported by the evidence.
