[PUBLISHED] [Melloy, Author, with Wollman and Loken, Circuit Judges] Civil case - Bankruptcy. After hundreds of claims under the Minnesota Child Victim's Act were filed against the Archdiocese of St. Paul, it filed for Chapter 11 relief. The Official Committee of Unsecured Creditors represents more than 400 clergy sexual abuse claimants, and after the Archdiocese filed for bankruptcy, it filed a motion to substantively consolidate the Archdiocese with over 200 affiliated non-profit corporations, including schools, cemeteries, foundations and chaplaincies (the "Targeted Entities"; the bankruptcy court did not err in denying the motion for substantive consolidation as the Committee failed to plausibly allege sufficient facts to negate the non-profit non-debtor status of the these Targeted Entities; as a result, the Targeted Entities are entitled to the protections provided under 11 U.S.C. Sec. 303(a) of the Code.
