U.S. Court of Appeals Case No: 17-1084
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Colloton, Author, with Loken and Beam, Circuit Judges] Criminal case - Criminal law. While the defendant's offense of conviction did not authorize the amount of restitution ordered, defendant's plea agreement allowed the court to consider other criminal conduct that would justify the amount of restitution imposed, and the district court did not err in finding defendant conspired with others to defraud the United States of an amount that justified the award; district court clerk's disbursal of the funds held in the court's registry account did not moot the appeal because a portion of the restitution was not due until defendant completed her sentence, and the court has not been notified that defendant paid the amount or that the court disbursed such funds to the victims.
