U.S. Court of Appeals Case No: 17-1167
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Erickson, Author, with Loken and Gruender, Circuit Judges]
Civil case - Federal Railway Safety Act. The district court did not err in
granting the railroad summary judgment on plaintiff's FRSA retaliation
claim as a reasonable jury could not find retaliation for plaintiff's
reporting of a workplace injury was a contributing factor to his
separation from employment with the railroad; plaintiff did not provide
proof by a preponderance of the evidence that his separation from
employment was the result of retaliation for seeking medical treatment.
