U.S. Court of Appeals Case No: 17-1191
U.S. District Court for the Western District of Arkansas - Fayetteville
[PUBLISHED] [Arnold, Author, with Smith, Chief Judge, and Kelly, Circuit
Judge]
Civil case. In action alleging defendant had improperly used charitable
donations, the district court erred in denying defendant's motion to
compel arbitration of the claims based on language found in the "Statement
of Agreement" plaintiffs had signed; properly read, the arbitration
agreement created an enforceable reciprocal agreement to arbitrate
disputes; defendant's promise to be bound by the result of an arbitration
agreement that plaintiffs initiated was sufficient consideration to render
the agreements enforceable; dispute was within the scope of the agreement.
Judge Kelly, dissenting.
