U.S. Court of Appeals Case No: 17-1236
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Murphy, Author, with Wollman and Loken, Circuit Judges]
Criminal case - Criminal law. Evidence was sufficient to support
defendant's convictions for conspiracy to commit visa fraud, fraud in
foreign labor contracting and mail and wire fraud; incident defendant
relied on to support her motions to question the jurors and grant a new
trial - that an Assistant U.S. Attorney heard a juror say the word
"guilty" in the presence of other jurors in an elevator - was insufficient
to show the jurors had discussed the case or, if they did, that they
considered improper evidence; further, the court offered an appropriate
curative instruction before the jury began its deliberations.
