Civil case - Civil rights. In a civil rights action by a Holmes following
the grant of habeas relief based on the defendant police officers'
misconduct in Holmes's conviction on drug and firearms charges, the
district court did not err in excluding evidence of Holmes's prior arrests
on drug offenses under Rule 404(b); nor did the court err in permitting
limited testimony by the U.S. Attorney who prosecuted defendant Garrett as
the evidence helped the jury understand the criminal charges which had
been filed; nor did the court err in permitting Holmes to introduce expert
testimony on police practices from a psychologist who was also a former
police captain and police psychologist; the psychologist's testimony on
best practices was relevant as it went to professional standards for
police conduct and police protocols; evidence was sufficient to establish
a conspiracy to violate Holmes's civil rights; evidence was sufficient to
support the jury's verdict for Holmes on his state law claims for false
imprisonment and malicious prosecution; challenges to jury instructions on
conspiracy, malicious prosecution and damages rejected.
