U.S. Court of Appeals Case No: 17-1385
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Smith, Author, with Murphy and Colloton, Circuit Judges]
Civil case - Civil rights. This opinion is issued by Chief Judge Smith and
Judge Colloton pursuant to 8th Cir. R. 47E. The resolution of the
conflicting testimony between one officer's more or less contemporaneous
statement to investigators and all of the officers' subsequent unified
deposition testimony is best left to a jury, and the district court erred
in granting defendants' motion for summary judgment based on qualified
immunity; because the court has reversed on this issue, the district
court's order granting summary judgment for defendants on plaintiff's
state law claims for wrongful death and vicarious liability is also
reversed.
