U.S. Court of Appeals Case No: 17-1402
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Loken, Author, with Gruender and Kelly, Circuit Judges]
Criminal case - Sentencing. For the court's prior opinion in the case
remanding the matter for resentencing in light of Johnson, see United
States v. Eason, 829 F.3d 633 (8th Cir. 2016). On remand, the district
court did not err in reopening the sentencing record to permit the
government to supplement the record with state court judicial records
which were relevant to the force clause issue; the district court did not
err in determining defendant's convictions for third degree domestic
battery in violation of Ark. Code Ann. Sec. 5-26-503(a)(1) and first
degree battery under Ark. Code Ann. Sec. 5-13-201(a)(8) were violent
felonies under the Armed Career Criminal Act's force clause; the district
court did not err in imposing an enhancement under Guidelines Sec.
4B1.4(b)(3)(A) for using or possessing an unlawfully possessed weapon in
connection with a crime of violence.
