[PUBLISHED] [Erickson, Author, with Loken and Benton, Circuit Judges] Criminal case - Sentencing. Defendant's plea agreement waived his right of appeal, and his appeal of the imposition of a special condition of release governing his internet access fell within the scope of the waiver; the appeal is dismissed. Even if the waiver did not bar the appeal, the condition was fully justified by defendant's conduct, which included, beside possession of child pornography on his computer, his use of the internet to steal another person's identity so that he could avoid his responsibility to register as a sex offender; further, the court specifically addressed defendant's concerns that he be able to use a computer to access religious materials and communicate with his family.
