U.S. Court of Appeals Case No: 17-1818
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Erickson, Author, with Loken and Benton, Circuit Judges]
Civil case - Class Action. In this class action concerning the triggers on
Walker Fire Control built Remington rifles, the notice of the settlement
was adequate as the supplemental notice plan included a social media
campaign, radio advertising, email notices, direct mailings and vendor
posters; a low claim submission rate, while not ideal, is not necessarily
indicative of a deficient notice plan and the district court did not abuse
its discretion in approving the notice plan; the proposed settlement was
fair, reasonable and adequate and followed meaningful discovery and
investigation by class counsel and arm's length negotiations.
