U.S. Court of Appeals Case No: 17-2130
U.S. District Court for the District of South Dakota - Sioux Falls
[PUBLISHED] [Kelly, Author, with Wollman and Arnold, Circuit Judges]
Civil case - Uniformed Services Employment and Reemployment Act. The
record clearly indicated that defendant replaced plaintiff while she was
on military duty and did not later reemploy her when she returned
following her service; the Act applies to employees, like plaintiff, who
lack guaranteed shifts, as the Act's implementing regulations make clear
that even temporary, probationary and seasonal employees enjoy USERRA
protection; the record showed defendant willfully violated the Act, and
plaintiff was entitled to liquidated damages.
