U.S. Court of Appeals Case No: 17-2231
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Stras, Author, with Wollman and Arnold, Circuit Judges]
Civil case - Employment discrimination. Because plaintiff's claim is
substantially dependent on analysis of the collective bargaining
agreement, Section 301 of the Labor Management Relations Act completely
preempts his disability discrimination claim under the Minnesota Human
Rights Act, and the district court had jurisdiction over this removed
matter; the district court properly granted judgment on the pleadings as
plaintiff's Section 301 claim was untimely.
