Civil case - Election Law. In this action the district court permanently
enjoined enforcement of Missouri Constitution Article VIII, Section
23.3(12), which prohibits a political action committee from receiving
contributions from other political committees on the ground the
prohibitions unconstitutionally infringes on a political action
committee's First Amendment rights to freedom of speech and association;
the transfer ban does little, if anything, to further the objective of
preventing corruption or the appearance of corruption, the only legitimate
state interest in restricting campaign finances, and the prohibition is
not closely drawn to serve an important state interest. The district
court's order is affirmed.
