U.S. Court of Appeals Case No: 17-2245
U.S. District Court for the Eastern District of Arkansas - Batesville
[PUBLISHED] [Colloton, Author, with Shepherd and Stras, Circuit Judges]
Civil case - Social Security. This court has long held that before an ALJ
can rely on a vocational expert's testimony that appears to conflict with
a Dictionary of Occupational Titles listing, the ALJ must identify and
resolve the conflict; here, the vocational expert's testimony appears to
conflict with the DOT's listing with respect to the level of reasoning
required for the job of hospital or industrial cleaner; the ALJ did not
adequately address this apparent conflict, and the matter must be remanded
for further proceedings.
