U.S. Court of Appeals Case No: 17-2341
and No: 17-2850
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Kelly, Author, with Gruender and Grasz, Circuit Judges]
Criminal case - Criminal law and sentencing. Reviewed under the plain
error standard because the issues were not raised before the district
court, neither defendant could establish the district court's alleged
failure to follow the procedures to establish prior convictions as
required by 21 U.S.C. Sec. 851 affected their substantial rights; if the
district court made certain Rule 11 errors, the errors were harmless and
did not affect defendant House's substantial rights; the district court
did not err in determining the amount of drugs attributable to defendant
Van Pelt for sentencing purposes, nor did it err in imposing a leadership
role enhancement under Guidelines Sec. 3B1.1(c)
