U.S. Court of Appeals Case No: 17-2441
U.S. District Court for the Western District of Missouri - St. Joseph
[PUBLISHED] [Kelly, Author, with Gruender and Grasz, Circuit Judges]
Civil case - Arbitration. The district court erred in vacating the
arbitration award Russell received against his insurer for wrongfully
denying his claim for damage to his 2013 corn crop; the arbitrators
rendered a sufficiently mutual, final and definite award; the arbitration
panel's failure to break down the award by county did not mean that it so
imperfectly executed its powers that it did not render a mutual, final and
definite award; panel's written explanation of the award amount was
adequate; remanded for further proceedings.
