U.S. Court of Appeals Case No: 17-2612
U.S. District Court for the Western District of Arkansas - Ft. Smith
[PUBLISHED] [Melloy, Author, with Gruender and Grasz, Circuit Judges]
Civil case - Attorneys' Fees. As part of their settlement of this Fair
Labor Standards Act, the parties agreed that plaintiffs would be awarded
$87,500 in attorneys' fees and costs; the district court reduced the award
to $22,500 based, in part, on the amount the plaintiffs recovered in the
matter; reversed and remanded with directions to award the agreed-upon
amount of fees and costs; in light of the need to focus on multiple
factors in assessing fairness and reasonableness, and in light of the
strong likelihood that the parties' agreement is reasonable, the court
finds that any required review of the award by the district court is light
and that the award is not outside the range of what would be approved.
