U.S. Court of Appeals Case No: 17-2826
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Arnold, Author, with Wollman and Kelly, Circuit Judges]
Civil case - Fair Debt Collection Practices Act. A false representation of
the amount of a debt that overstates what is owed under state law
materially violates 15 U.S.C. Sec. 1692e(2)(A), and the district court
erred in holding that the allegation under review - that defendant's
letter to plaintiff attempted to collect, and asserted he owed, compound
interest in violation of Minn. Stat. Sec. 334.01 - did not state a
plausible claim under Section 1692e and 1692f; remanded for further
proceedings.
