   Civil Case - USERRA. District court erred in granting summary judgment on 
   claim of a denial of reemployment as required under the Uniformed Services 
   Employment and Reemployment Rights of 1994, where there were factual 
   disputes as to whether Scudder resigned from his employment and waived his 
   USSERA rights, whether he applied for reemployment by applying for a 
   similar store manager position, and whether his receipt of social security 
   benefits barred his USERRA claim. The grant of summary judgment is 
   reversed and remanded.
