defendant's curtilage was a constitutionally permissible knock and talk,
and the district court properly denied defendant's motion to suppress;
Selective prosecution argument rejected as the Justice Department memos
regarding prosecutions in states where marijuana-related conduct was legal
(the Cole memos) did not create a policy by which residents of states
where marijuana has been legal are affirmatively treated differently from
those states where it has not. Judge Grasz, concurring in part and
dissenting in part.
