[PUBLISHED] [Loken, Author, with Gruender and Erickson, Circuit Judges] Civil case - Economic Duress. The district court did not err in determining that under Nebraska law, plaintiff had failed to show economic duress as a matter of law; nor did she establish a fraudulent misrepresentation on which she relied in entering into a purchase agreement; as a result, the agreement's mutual release provision bars laintiff's other claims, including a claim that defendant breached his fiduciary duty to a minority shareholder by forcing plaintiff to sell her shares and a claim that defendant had previously deprived her of a corporate opportunity.
