U.S. Court of Appeals Case No: 17-3196
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Benton, Author, with Beam and Erickson, Circuit Judges]
Civil case - Employment discrimination. In action alleging defendants
violated plaintiff's Title VII and Nebraska Fair Employment Practice Act
by failing to reinstate her, plaintiff's complaint was insufficient to
adequately plead a claim for discriminatory refusal to reinstate based
upon a theory of disparate treatment, as she failed to allege facts
showing that a male to whom she compares herself was reinstated or was
similarly situated; her complaint likewise failed to adequately plead a
claim under the Nebraska Act.
