U.S. Court of Appeals Case No: 17-3355
U.S. District Court for the Eastern District of Missouri - Cape Girardeau
[PUBLISHED] [Colloton, Author, with Gruender and Grasz, Circuit Judges]
Civil case - Insurance. Hartford's cancellation of an insurance policy,
after a worker's compensation claim had arisen under the policy, was void
under Mo. Rev. Ttat. Section 379.195.2; assuming for the sake of analysis
that Hartford properly pleaded the affirmative defense of mutual mistake,
it failed to identify any mutual mistake during the formation of the
insurance contract, and the district court did not err in rejecting the
defense.
