Civil Case - ERISA. The district court did not err in applying an
abuse-of-discretion review of the company's benefits determination, as
Leiter did not show that a serious procedural irregularity existed which
caused a serious breach of the plan administrator's fiduciary duty to him:
Leiter was not prejudiced by any omission in providing Plan documents to
him; his claim that a nurse provided his doctor with an incomplete
definition of total disability was not presented to the district court and
will not be considered on appeal; and the company's denial letter
adequately apprised Leirer of the reasons underlying the company's
decision. Substantial evidence supported the decision to deny total
disability benefits, and the district court did not abuse its discretion
in denying total disability benefits or in declining to remand for further
discovery. The district court did not abuse its discretion in failing to
award statutory penalties for failing to provide him with 2012 Plan
documents, as he was not prejudiced and he did not show bad faith.
