U.S. Court of Appeals Case No: 17-3716
U.S. District Court for the Eastern District of Missouri - Hannibal
[PUBLISHED] [Smith, Author, with Colloton and Erickson, Circuit Judges]
Civil case - Insurance. The district court erred in granting the insurer
summary judgment because issues of material fact remain regarding the
causation of an auto accident involving plaintiff and a known second
driver, particularly whether a third, unidentified driver's act was an act
of concurring or contributing negligence which gave plaintiff a legal
entitlement to recover under the uninsured motorist provision in his
American Family policy.
