[PUBLISHED] [Melloy, Author, with Smith, Chief Judge] Prisoner case - Prisoner civil rights. This opinion is issued by a two-judge panel pursuant to 8th Cir. R. 47E. Viewing the record in the light most favorable to plaintiff, defendants' decision to halt plaintiff's Avonex injections did not rise to a level akin to criminal recklessness; assuming plaintiff did not refuse the injections, he complained about the side effects of the drug and it was well within the defendant's independent medical judgment to discontinue the treatment; further, defendants continued to provide medical care after the injections were halted and no rational trier of facts could find that defendants were deliberately indifferent.
