and the claim is waived; the district court did not err in determining
that the Fair Labor Standards Act's anti-retaliation provision did not
apply to a prospective employer; plaintiff failed to state a due process
claims because his complaint failed to satisfy the "stigma-plus" test;
plaintiff failed to adequately plead a Section 1985(2) conspiracy; no
error in dismissing plaintiff's state law claims or in denying him leave
to file a proposed third amended complaint. Judge Erickson, concurring.
