U.S. Court of Appeals Case No: 18-1352
Petition for Review of an Order of the Board of Immigration Appeals
[PUBLISHED] [Shepherd, Author, with Wollman and Gruender, Circuit Judges]
Petition for Review - Immigration. The IJ did not err in determining
petitioner's asylum application was untimely and that it was not
reasonable for petitioner to file the application more than six months
late - see 8 U.S.C. Sec. 1158(a)(2)(D) which creates an exception for late
filings made within a "reasonable period of time following expiration of
lawful status;" petitioner abandoned most of his arguments that the
discrimination he suffered in Bangladesh constituted persecution for
purposes of withholding removal by failing to raise the issues before the
BIA; with respect to the one incident he did raise, the record fails to
show that the alleged acts rose to the level of persecution; further,
petitioner did not contest to the BIA the IJ's denial of CAT relief, and
that issue is also abandoned.
