U.S. Court of Appeals Case No: 18-1503
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Shepherd, Author, with Arnold and Erickson, Circuit Judges]
Criminal case - Sentencing. Reviewed under the plain error standard, the
district court's decision to impose a special condition that defendant not
possess or use a computer or have access to any online service without
prior approval of the Probation office did not involve a greater
deprivation of liberty than was reasonably necessary, in that it was not a
complete ban on Internet access and there was ample evidence that
defendant used his devices for activities beyond simply possessing child
pornography, including producing child pornography.
