[PUBLISHED] [Wollman, Author, with Gruender and Shepherd, Circuit Judges] Criminal case - Sentencing. Based on the sentencing record, the district court did not clearly err in finding defendant had a propensity to use firearms in criminal activity; the district court's explanation of its decision to impose a significant upward variance, while perhaps testing brevity's acceptable limits, was sufficient, as it showed the court had considered the 3553(a) factors and defendant's sentencing memorandum and was aware of defendant's mitigating factors; defendant's sentence, an upward variance from the advisory Guidelines range of 15-21 months to the statutory maximum of 120 months, was not substantively unreasonable, given uncharged conduct and the danger defendant poses to the community with his repeated possession and use of weapons.
