U.S. Court of Appeals Case No: 18-1827
U.S. District Court for the District of Nebraska - Lincoln
[PUBLISHED] [Shepherd, Author, with Colloton and Melloy, Circuit Judges]
Civil case - Civil rights. Defendant Deputy Lesa's encounter with
plaintiff on a parking lot where she checked his ID and ran his records
was not a seizure and did not violate plaintiff's Fourth Amendment rights;
for Fourth Amendment purposes the relevant question is whether an arrest
was reasonable, not whether an arrest violated state law or whether the
arresting officer was acting within his geographical jurisdiction and, as
a result, defendant officer Hein and Deputy Lesan did not violate the
Fourth Amendment solely by arresting plaintiff outside of the Lincoln,
Nebraska city limits; arguments plaintiff asserts concerning his right to
be free from excessive force are raised for the first time on appeal and
would not be considered; the exhibits submitted in support of defendants'
motion for summary judgment were properly admitted.
