U.S. Court of Appeals Case No: 18-1902
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Melloy, Author, with Colloton and Shepherd, Circuit Judges]
Civil case - Americans with Disability Act. Job attendance was an
essential function of plaintiff's job as a Union Pacific Locomotive
Engineer and plaintiff could not perform that function with or without a
reasonable accommodation; he could not establish a prima facie case of ADA
discrimination, and the district court did not err in granting Union
Pacific's motion for summary judgment.
