U.S. Court of Appeals Case No: 18-2121
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Colloton, Author, with Beam and Kelly, Circuit Judges]
Civil case - Antitrust. In this action D&G alleged defendant violated the
Sherman Act when it entered into an agreement with another grocery
wholesaler not to compete for customers in certain geographic areas for a
certain period of time. For the court's prior opinions in the matter, see
In re Wholesale Grocery Prod. Antitrust Litig., 946 F.3d 995 (8th Cir.
2019); 752 F.3d 728 (8th Cir. 2014) and 707 F.3d 917 (8th Cir. 2013). The
jury found for defendant on D&G's claims and defendant appeals,
challenging the jury instructions and verdict form. Held, the instructions
fairly and adequately submitted the issues and the verdict form did not
mislead the jury.
