U.S. Court of Appeals Case No: 18-2352
and No: 18-2577
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Shepherd, Author, with Melloy and Grasz, Circuit Judges]
Civil case - Americans with Disabilities Act. In action against a live
performance theater under the ADA's auxiliary aids and services
requirements, the district court did not err in finding that defendant's
failure to offer captioning at any performance where captions were
requested denied deaf persons services and violated the ADA; one captioned
performance per run of a show denied hearing impaired persons an equal
opportunity to gain the same benefit as persons without impairments and
denied them meaningful access to benefits the Fox Theater provided; no
error in awarding plaintiffs attorneys' fees. Judge Grasz, dissenting.
