U.S. Court of Appeals Case No: 18-2776
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Gruender, Author, with Benton and Grasz, Circuit Judges] Civil case - Fair Debt Collection Practices Act. Use of an abbreviation for defendant's other registered name and the phrase "Professional Debt Collectors" in correspondence was not false, misleading or deceptive and plaintiff failed to plead sufficient factual matter to state a plausible claim defendant violated the Act; inclusion of a non-licensed signatory in the signature block did not violate the Act as the other two signatories were licensed, as was defendant; the district court properly concluded Minnesota law does not prohibit defendant from seeking pre-judgment interest.
