U.S. Court of Appeals Case No: 18-3081
U.S. District Court for the District of Minnesota
[PUBLISHED] [Loken, Author, with Shepherd and Stras, Circuit Judges]
Criminal case - Restitution. The district court did not err in requiring
defendant to pay $19,619 in restitution to repair the damage he caused
when he shot into a Customs and Border Protection helicopter that was
flying over his property; the district court properly deferred its
restitution order until the defense could examine certain documents and
decide whether to challenge the government's evidence on the extent of the
damaged and cost of repairs; the district court did not abuse its
discretion by granting an extension of time to finally determine the
amount of restitution because the extension did not prejudice defendant's
ability to challenge the claim; the district court did not err in
determining the government had adequately documented the extent of the
damage and cost of repairs.
