U.S. Court of Appeals Case No: 18-3254
U.S. District Court for the District of Minnesota
[PUBLISHED] [Loken, Author, with Shepherd and Stras, Circuit Judges]
Civil case - Defamation. Under Minnesota law a corporation is a public
figure and in order to state a claim for defamation, a plaintiff
corporation must show the challenged statement was made with actual
malice; here, the defendant TV station published a story of legitimate
public interest, namely criminal charges arising out of an investigation
as to whether plaintiff had overcharged local police departments; the
district court did not err in concluding there was no plausible inference
of actual malice and the allegations showed nothing more than oversight on
defendant's part.
