U.S. Court of Appeals Case No: 18-3489
Appeal from the Bankruptcy Appellate Panel for the Eighth Circuit
[PUBLISHED] [Benton, Author, with Colloton and Wollman, Circuit Judges]
Civil case - Bankruptcy. The Bankruptcy Appellate Panel erred in
concluding Lariat's claim against Wrigley no longer exists because her
husband discharged his liabilities in an earlier bankruptcy; the husband's
payment did not cover all of the money owed, and Minnesota courts ruled
that a fraudulent-transfer judgment existed after the husband's discharge;
as a result her husband's discharge did not extinguish Wrigley's liability
under the fraudulent-transfer judgment; the Section 502(b)(6) cap applies
to Wrigley's liability; remanded to the Bankruptcy Court with directions
to enter an order that Lariat has a claim against Wrigley for $308,805,
plus interest.
