U.S. Court of Appeals Case No: 18-3550
Petition for Review of an Order of the Board of Immigration Appeals
[PUBLISHED] [Gruender, Author, with Kelly and Erickson, Circuit Judges]
Petition for Review - Immigration. Petitioner's arguments that BIA
incorrectly applied the clear error standard of review and engaged in
improper fact-finding are not before the court as petitioner failed to
raise the arguments in his initial appeal from the IJ's decision and
failed to petition for review of the denial of his motion for
reconsideration; The BIA did not err in denying petitioner's application
for relief under the Convention Against Torture based on its determination
that petitioner had not established that it was more likely than not that
he would be tortured either by or with the consent of South Sudanese
officials if he were returned to the country; the decision is supported by
substantial evidence because the BIA correctly concluded that petitioner
must show more than a pattern of general ethnic violence in South Sudan to
meet CAT's likelihood requirement. Judge Kelly, dissenting.
