U.S. Court of Appeals Case No: 18-6007
U.S. Bankruptcy Court for the Western District of Arkansas - Fayetteville
[PUBLISHED] [Nail, Author, with Saladino, Chief Judge, and Shodeen,
Circuit Judge]
Bankruptcy Appellate Panel. The trustee objected to Debtor's second
amended claim of exemptions on the ground it was filed in bad faith and
was prejudicial to debtor's creditors. A bankruptcy court has no authority
under federal law to deny an exemption on a ground not specified in the
bankruptcy code. See Law v. Siegal, 571 U.S. 415 (2014). As a result, the
bankruptcy court's order overruling the trustee's objection to debtor's
second amended claim of exemptions is affirmed.
