U.S. Court of Appeals Case No: 19-1142
U.S. District Court for the District of Minnesota
[PUBLISHED] [Erickson, Author, with Grasz and Kobes, Circuit Judges]
Civil case - Employment discrimination. Defendant considered plaintiff's
race only to ensure that any corrective action was not based on racial
discrimination; without direct evidence of discrimination, the court
applies the McDonnell Douglas analysis and determines that even if
plaintiff made a prima facie case of discrimination, defendant had a
legitimate, non-discriminatory reason for plaintiff's termination -
violation of defendant's Violence-Free Workplace policy - and plaintiff
failed to show the reason was a pretext for racial discrimination.
