Civil case - Immigration. A noncitizen who enters this country without
inspection or admission, but who later receives Temporary Protected
Status, may adjust her status to Lawful Permanent Resident because a TPS
recipient is deemed inspected and admitted for purposes of 8 U.S.C. Sec.
1255(a) - see 8 U.S.C. Sec. 1254a)f)(4)- and the U.S. Citizenship and
Immigration Services's contrary interpretation conflicts with the plain
language of the Immigration and Naturalization Act and is unlawful. Judge
Loken, dissenting.
